These Terms of Service govern access to and use of the Tallmark website and the accounting services provided by Tallmark. By using this website or engaging our services, you agree to the terms described below. Please read them carefully before proceeding.
1. Use of the website and services
1.1 Acceptable use
You may use this website and its content for lawful purposes only. Use of the site to transmit harmful, fraudulent, or deceptive content, or to interfere with the operation of the site or connected services, is prohibited. You agree not to attempt to gain unauthorized access to any part of this site or its underlying systems.
1.2 Permitted uses
You may browse this website, submit enquiries through the contact form, review service information, and engage Tallmark for accounting services. All other uses require prior written consent from Tallmark.
1.3 Service access requirements
Access to certain services may require you to provide accurate business information, agree to a separate service agreement, and maintain communication with the Tallmark team at agreed intervals. Providing false or misleading information may result in termination of service.
1.4 Fair usage
Tallmark's services are designed for small business use within the scope described on the relevant service page. Use of services outside the agreed scope — for example, requesting significantly more work than the engagement covers — may require a revised arrangement or separate fee.
2. Account and access terms
2.1 Account creation. Access to certain features or communication channels may require creating an account or providing credentials to third-party platforms used in service delivery (such as accounting software). You are responsible for maintaining the confidentiality of any such credentials.
2.2 Account security. You must promptly notify Tallmark if you suspect unauthorized use of your account or any security breach affecting shared tools or data. We are not liable for losses arising from unauthorized access that results from your failure to secure your credentials.
2.3 Suspension and termination. Tallmark reserves the right to suspend or terminate access to services in cases of material breach of these terms, non-payment, or conduct that undermines the professional relationship. Where possible, we will provide reasonable notice before taking such action.
2.4 Multiple accounts. Engaging Tallmark for multiple businesses or entities requires a separate service agreement for each entity, unless a consolidated arrangement has been agreed in writing.
3. Service availability and modifications
3.1 Website availability. We aim to keep this website available at all times but cannot guarantee uninterrupted access. Scheduled maintenance, technical issues, or circumstances beyond our control may occasionally affect availability.
3.2 Service delivery. Tallmark will use reasonable efforts to deliver services within agreed timelines. Delays caused by incomplete or late information from the client, system outages at third-party platforms, or other factors outside our control are not considered service failures.
3.3 Geographic availability. Our services are available to small businesses operating internationally. However, we do not provide tax advice, legal advice, or jurisdiction-specific regulatory guidance. You are responsible for ensuring compliance with local laws relevant to your business.
3.4 Service modifications. Tallmark may update, expand, or discontinue specific service offerings. Where changes affect an existing engagement, we will provide reasonable advance notice and, where appropriate, discuss alternatives with affected clients.
4. Intellectual property
4.1 Site content ownership. All content on this website — including text, layout, design, and graphics — is the property of Tallmark or its licensors. Reproduction, distribution, or commercial use of any content without prior written consent is not permitted.
4.2 Client data. Data and records you provide in connection with Tallmark's services remain your property. Tallmark uses that data solely to provide the services you have engaged and will not share it beyond what is necessary to do so.
4.3 Deliverables. Reports, summaries, and other deliverables produced as part of a service engagement are provided for your business use. They may not be redistributed, published, or represented as independent professional advice to third parties.
4.4 Trademarks. The Tallmark name and any associated logos are not to be used in any context that could imply a commercial relationship, endorsement, or affiliation without written permission.
